Final Rule Issued on Classifying Employees and Independent Contractors Under the FLSA

The U.S. Department of Labor published its final rule defining independent contractors on January 10, 2024. The final rule addresses how to determine whether a worker is properly classified as an employee or independent contractor under the Fair Labor Standards Act (FLSA or Act). The final rule implements a six-factor test for worker classification to be used to make the determination and becomes effective on March 11, 2024, although litigation to block the rule has already been filed.
